Platform Operator
Regenyx® digital platform (the “Platform”) is operated by Regenyx Health & Wellness, LLC, a non-clinical technology company that provides digital infrastructure and administrative support services (“Regenyx,” “we,” “us,” or “our”).
Acceptance of Terms
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.
No Medical Care or Medical Advice
Regenyx does not provide medical care, medical advice, diagnoses, or treatment, and does not practice medicine or any other licensed profession. Regenyx does not control or influence medical decision-making.
Independent Healthcare Providers
Medical services that may be made available through the Platform are provided solely by independent, licensed healthcare professionals or professional entities that are not owned, operated, or controlled by Regenyx (each, a “Provider”). Providers are solely responsible for all medical judgment, diagnosis, treatment, prescribing decisions, and patient care.
Use of Technology and Records
Regenyx provides software tools, record-keeping infrastructure, and other digital resources that may be used by Providers in connection with their independent medical practices. Regenyx does not supervise, manage, or direct Providers’ clinical activities and does not exercise medical judgment.
General Information
Any informational materials or content made available on the Platform are provided for general informational purposes only and are not a substitute for professional medical advice, diagnosis, or treatment. Reliance on such content is at your own risk.
Pharmacy Services
Any medications made available to users are dispensed by independent, licensed pharmacies. Regenyx does not own or operate pharmacies and does not manufacture, compound, or dispense medications.
Payments and Administrative Services
Regenyx may facilitate payments and provide non-clinical administrative or operational services through the Platform. Regenyx does not set prices for medical services and does not receive fees based on medical judgment or prescribing decisions.
Private-Pay Services. All services made available through the Platform are offered on a private-pay basis only. Regenyx and the Providers do not submit claims to private insurance, Medicare, Medicaid, or other government healthcare programs. Users are responsible for payment of all applicable fees.
Eligibility and Use of the Platform
You must be at least eighteen (18) years old and capable of entering into a legally binding agreement to use the Platform. You represent that all information you provide is accurate and complete.
User Accounts and Responsibilities
You may be required to create an account to access certain features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Regenyx immediately of any unauthorized use.
Telehealth Consent
By using the Platform to access services from Providers, you acknowledge and consent to the use of telehealth technologies where permitted by applicable law. Telehealth involves electronic communications that allow Providers to deliver services remotely. You understand the benefits and limitations of telehealth and may withdraw consent at any time by discontinuing use of the Platform or notifying the applicable Provider.
No Emergency Services
The Platform is not intended for emergency use. If you believe you are experiencing a medical emergency, call 911 or seek immediate in-person emergency care.
User Conduct
You agree not to:
Use the Platform for any unlawful or fraudulent purpose
Interfere with or disrupt the operation or security of the Platform
Attempt to gain unauthorized access to systems or data
Provide false, misleading, or inaccurate information Regenyx may suspend or terminate your access to the Platform for violations of these Terms.
Intellectual Property
All content, software, trademarks, logos, and other materials made available through the Platform are owned by or licensed to Regenyx and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes in accordance with these Terms.
Third-Party Services and Links
The Platform may include links to or integrations with third-party services, including Provider services and pharmacy services. Regenyx does not control and is not responsible for the content, policies, or practices of any third party.
Disclaimer of Warranties
The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, Regenyx disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the maximum extent permitted by law, Regenyx shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. Regenyx is not responsible for the acts or omissions of Providers or pharmacies.
Indemnification
You agree to indemnify and hold harmless Regenyx from and against any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your interactions with Providers or third parties.
Arbitration and Class Action Waiver
Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration on an individual basis, and not as a class or collective action, except where prohibited by law. Arbitration procedures, governing rules, opt-out rights, and exceptions are described in this section.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Changes to These Terms
Regenyx may modify these Terms from time to time. Changes are effective upon posting to the Platform. Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
